2. Description of Services
Appraisal Host provides cloud-based appraisal management software designed for Appraisal Management Companies (AMCs), mortgage lenders, banks, and appraisal companies. Our platform includes:
- Order Management: Tools for creating, tracking, and managing appraisal orders throughout the entire lifecycle.
- Appraiser Panel Management: Credential tracking, coverage area mapping, and automated assignment capabilities.
- Compliance Tools: AIR (Appraiser Independence Requirements) enforcement, USPAP tracking, and audit trail maintenance.
- LOS Integration: Bi-directional data sync with loan origination systems including Encompass, Calyx Point, and BytePro.
- GSE Portal Integration: Automated submission to Fannie Mae, Freddie Mac, and FHA through Veros and Bradford Technologies.
- Reporting and Analytics: Customizable reports, turn time analysis, and performance metrics.
- Mobile Applications: iOS and Android apps for field appraisers.
- API Access: REST API for custom integrations and workflow automation.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice to users for material changes.
3. User Accounts
To access the Service, you must create an account. You are responsible for:
- Account Security: Maintaining the confidentiality of your account credentials, including username and password.
- Account Activity: All activities that occur under your account, whether authorized or unauthorized.

You agree not to use the Service to:
- Violate any applicable federal, state, local, or international laws or regulations.
- Infringe upon the intellectual property rights, privacy rights, or other rights of others.
- Transmit harmful, offensive, defamatory, or inappropriate content.
- Attempt to gain unauthorized access to our systems, networks, or other users' accounts.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.

You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.
5.2 Your Content
You retain ownership of any content you submit to the Service, including appraisal orders, appraiser information, and documents. By submitting content, you grant us a limited, non-exclusive, royalty-free license to use, store, process, and display that content solely for the purpose of providing the Service to you.
You represent and warrant that you have all necessary rights to submit your content and that your content does not violate any third-party rights or applicable laws.
6. Payment Terms
If you purchase services from us, you agree to the following payment terms:
- Fees: You agree to pay all fees and charges according to the pricing and payment terms presented to you during signup or as agreed in your contract.
- Billing: Fees are billed in advance on a monthly or annual basis, depending on your subscription plan.
- Payment Methods: We accept credit cards, ACH transfers, and other payment methods as specified during checkout.
- Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
- Price Changes: We may change our pricing with 30 days' notice. Price changes will not affect your current billing period.
- Late Payments: Accounts with overdue payments may be suspended until payment is received.
- Taxes: Fees do not include applicable sales tax, VAT, or other taxes, which will be added to your invoice as required by law.

7.2 Cancellation Policy
You may cancel your subscription at any time by contacting us at . Upon cancellation:
- Your subscription will remain active until the end of your current billing period.
- You will not be charged for subsequent billing periods.
- You will retain access to the Service until the end of your paid period.
- No refunds will be provided for partial billing periods unless required by law.
- You may request data export before your account is deactivated (see Section 8).
7.3 Refund Policy
All fees are non-refundable unless otherwise stated in your service agreement or required by law. If you are dissatisfied with the Service, please contact us to discuss your concerns before requesting a refund.
8. Data Ownership and Export
8.1 Your Data Ownership
You retain full ownership of all data you enter into the Service, including appraisal orders, appraiser information, client data, and documents. We do not claim any ownership rights to your data.
8.2 Data Export Rights
You have the right to export your data at any time in standard formats including:
- CSV exports for order data, appraiser information, and financial records
- PDF exports for reports and compliance documentation
- XML exports for appraisal reports and structured data
- Bulk document downloads for uploaded files and attachments
Upon account cancellation, we will provide a final data export opportunity. After account closure, your data will be retained for 90 days before permanent deletion, unless longer retention is required by law.
9. Uptime and Service Level Agreement
9.1 Uptime Commitment
Appraisal Host is committed to providing reliable service with 99.99% uptime, hosted on enterprise-grade AWS infrastructure. We monitor our systems 24/7 and perform regular maintenance to ensure optimal performance.
9.2 Scheduled Maintenance
We may perform scheduled maintenance that temporarily affects Service availability. We will provide advance notice of scheduled maintenance whenever possible, typically during off-peak hours.
9.3 Service Interruptions
While we strive for maximum uptime, the Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control (e.g., AWS outages, natural disasters, cyberattacks). We are not liable for temporary Service interruptions.
10. Disclaimers and Limitation of Liability
10.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, APPRAISAL HOST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not warrant that the Service will meet your specific requirements or that defects will be corrected.
10.2 Limitation of Liability
IN NO EVENT SHALL APPRAISAL HOST, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Appraisal Host and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights or privacy rights
- Your content submitted to the Service
- Any negligent or wrongful conduct by you or your users
12. Termination
12.1 Termination by You
You may terminate your account at any time by contacting us at . Upon termination, your subscription will remain active until the end of your current billing period.
12.2 Termination by Us
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:
- Breach of these Terms
- Non-payment of fees
- Violation of the Acceptable Use Policy
- Fraudulent or illegal activity
- Threat to the security or integrity of the Service
12.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. We will provide you with a 90-day grace period to export your data before permanent deletion. Sections of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, limitations of liability, and indemnification.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
